Although international arbitration and the European Union – two of the world's most robust international law regimes – have coexisted peacefully for decades, hostility between them has erupted, to the point that each of the two regimes regards the other as the prime threat to its authority. The contestation has been waged on several fronts and, while the termination of intra-EU bilateral investment agreements will mitigate them, mutual antagonism persists. How has this situation come about and how can it be addressed?
